Terms of Service
1. Agreement
By accessing or using SendRadar ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by Numeric Marketing LLC ("Company", "we", "us").
2. Service Description
SendRadar provides access to competitive email intelligence data aggregated from DTC brand marketing emails. The Service is intended for competitive intelligence and marketing research purposes.
3. Subscriptions and Payment
Access to paid features requires a Pro subscription. Subscriptions are billed monthly in advance. All payments are processed by Paddle.com, our authorised reseller and Merchant of Record. Paddle's terms apply to all transactions.
Subscriptions renew automatically unless cancelled before the renewal date. No refunds are issued for partial billing periods.
4. Acceptable Use
You may use the Service for lawful business purposes only. You may not: resell or redistribute data from the Service; scrape or bulk-export data beyond the features provided; attempt to circumvent access controls; or use the Service in any way that violates applicable law.
5. Data and Accuracy
Data provided by the Service is sourced from publicly available marketing emails and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any data. You are responsible for independently verifying information before making business decisions.
6. Intellectual Property
The Service, including its software, design, and compiled datasets, is owned by Numeric Marketing LLC. You receive a limited, non-exclusive, non-transferable licence to access the Service during your subscription period.
7. Termination
We may suspend or terminate your access at any time if you breach these Terms. You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period.
8. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that data will be current or accurate.
9. Limitation of Liability
To the maximum extent permitted by law, Numeric Marketing LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.
10. Governing Law
These Terms are governed by the laws of Georgia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Georgia.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify subscribers of material changes by email.
